Bankruptcy is a formal high court process only suitable if your debts exceed your assets by more than €20,000 and you do not qualify for any of the alternative solutions outlined in the Personal Insolvency Act 2012 to 2015.

Where To Start?

  • At the meeting, we will assess your options and let you know if Bankruptcy is the right solution for your situation.
  • We will file your application for a Bankruptcy Order in the Office of the  Examiner of the High Court.
  • You will be given a Court Hearing at the High Court in Dublin where the Judge will decide whether to declare you Bankrupt.
  • Once you are adjudicated Bankrupt, you will meet with the Insolvency Service who will be administering your case during the Bankruptcy term.

After one year, you will be discharged from bankruptcy and any debt remaining will be written off.

The Bankruptcy Process

What You Need To Do

Start collecting details of your debt – including a list of what you owe and to whom, details of payments you have missed, as well as details of your income, average spending needs and any assets you may have. Bring these with you to your meeting with the PIP.
